THE CFMEU has succeeded in getting an injunction against the Australian Federal Police from handling, viewing or copying any of the material or data seized during the raid on the CFMEU Canberra office on 25 August.
“Acting Justice Robinson of the ACT Supreme court said the CFMEU had an ‘arguable case’ in respect of its contentions that the issuing and execution of the search warrants was unlawful,” a spokesperson for the union said.
“Counsel for the Australian Federal Police agreed to an order that until the case was determined, it would not access or examine any of the material seized during the raid.The matter has been listed for hearing on October 12 and 13.
“The CFMEU will be seeking declarations that the police acted unlawfully and that all materials should be returned.”
